There Is No One Uniform Infertility Insurance Law In The US

Only about fifteen states in the US have actually enacted infertility insurance laws that necessitate that these states provide their citizens with infertility insurance coverage. So, it is clear that a majority of the states in the US do not have infertility insurance laws in place and furthermore there are also no federal laws that require that insurance plans must cover for fertility services.

States That Have Mandated Infertility Insurance Coverage

States such as Arkansas, Connecticut, Hawaii, Illinois, Maryland, Massachusetts, Montana, New York, Ohio, Rhode Island and West Virginia each has infertility insurance laws in place that mandate the insurance coverage that is provided by groups like health maintenance organizations or HMOs must offer infertility insurance coverage.

Furthermore, among these fifteen states that have mandated infertility insurance laws there are some states that specifically mandate that coverage be provided or offered for assisted reproductive technologies or ART though other states either limit this coverage or even exclude it entirely. Both California as well as Texas is states that have mandated infertility insurance coverage.

The rest of the states in the US that exclude these fifteen do not have any infertility insurance laws in place that require that citizens be offered or provided with infertility insurance coverage. Nevertheless, there are organizations such as American Fertility Association and also the organization that is known as RESOLVE that are canvassing for adoption of extra mandates to ensure that citizens in these states do get infertility insurance coverage.

There is in fact also a concerted effort being made in states such as Pennsylvania and Maine as too Florida to get infertility insurance law enacted. At the same time there is a move underfoot in Texas that aims to get the existing infertility insurance laws strengthened further.

The best place to find out more about infertility insurance laws in the entire USA is at the American Society for Reproductive Medicine or ASRM where you can learn about each infertility insurance law that is in effect in the different states in the US. In particular, the ASRM website asrm.org provides detailed explanation about the infertility insurance laws in the fifteen states where infertility insurance coverage is mandated.

RESOLVE is a nationally recognized organization that does a lot for people suffering from infertility. In fact, it is a great place to find infertility support. This is good news indeed because according to estimates about ten to fifteen percent of American couples are infertile and for them in particular an organization such as RESOLVE holds out much hope of coping with their very trying condition.
